Defendant was indicted on four counts on February 22nd, 1990, Count I was Aggravated Murder by calculation during a Kidnapping, Count II was Aggravated Murder while committing Kidnapping, Count III was Aggravated Murder by calculation while committing Aggravated Robbery. Pursuant to a written waiver and plea bargain with the prosecution, the defendant was offered a plea to Aggravated Murder with calculation and by Bill of Information, Aggravated Robbery. Defendant entered a plea on June 1, 1990 and was found guilty of Aggravated Murder receiving a sentence of twenty (20) years to life, concurrent with an indeterminate term of not less than five (5) years and not more than twenty-five (25) years on the charge of Aggravated Robbery. From that conviction defendant appealed, after the Court of Appeals granted her motion for a Delayed Appeal. Appellants Post-Conviction action was filed September 1996, with judgement entry being held until a decision was rendered from the Court of Appeals on said motion. On March 10th, 1997, opinion was filed in the Court of Appeals rendering Delayed Appeal overruled. On July 29th, 1997, decision and entry was filed in the Madison County
Court of Common Pleas, denying post-conviction hearing thus granting prosecutors
motion to dismiss. Defendant appealed from that judgement to the
Court of Appeals, Twelfth Appellate District, judgement being affirmed
on March l6th,1998.
